The Moderated Pretrial Settlement Conference
Judges in the Tenth Judicial District of Minnesota have begun ordering the parties and their lawyers to participate in a moderated settlement conference just prior to trial. Early Neutral Evaluation (ENE) is sometimes ineffective in resolving cases early in the case and prior to discovery due to a lack of trust in the forthrightness of the opponent and fear that money and property are being hidden. After discovery is completed, a moderated settlement conference with a "qualified neutral" may settle the case and allow the parties to avoid the great expense in attorney's fees in preparing for trial.
